These Terms of Use ("Terms") are an agreement between you and Insight Spatial LLC ("Insight Spatial," "we," "us") covering the Area Measure app. By installing or using the app, you agree to them. If you do not agree, do not use the app.
We grant you a personal, non-exclusive, non-transferable licence to use Area Measure on devices you own or control, for lawful personal or internal business purposes. The app is licensed, not sold. Use through Apple's Family Sharing or volume programs is permitted where Apple's rules allow it.
This is the most important thing on this page. Area Measure computes distances and areas from map coordinates and consumer GPS. Its results are estimates. They are not a land survey, not a legal boundary determination, and not a substitute for a licensed surveyor.
Accuracy is bounded by your device. Area Measure reads the position your iPhone's GPS reports and cannot make it better than the hardware allows; the app's own filtering only discards readings that are obviously bad. Whatever error the device has, the measurement inherits.
Beyond the device, accuracy depends on satellite visibility, tree cover, buildings, weather, the resolution and registration of the basemap imagery, and how carefully points are placed. Errors of several metres are normal, and larger errors are possible.
Do not rely on the app's output for property boundaries, legal descriptions, construction layout, regulatory filings, insurance claims, or any other purpose where an error could cause loss. For those, commission a professional survey. You are responsible for deciding whether a measurement is fit for your purpose, and for any decision you make from it.
You own the measurements, notes, photos, and exports you create. They are stored on your device; we do not receive them. You are responsible for backing them up, and for having the right to be on any land you measure and to photograph it.
Area Measure displays map imagery through Google Maps (the default) and Apple Maps. By using the app you also accept the Google Maps/Google Earth Additional Terms of Service, including the Google Privacy Policy. Apple's map data is subject to Apple's terms. You may not use the app to extract, cache, or redistribute map imagery outside of what those terms allow.
Do not reverse engineer, decompile, or attempt to extract our source code or credentials from the app, use it to break the law or trespass, or misrepresent its output as a professional survey.
The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any measurement will be accurate to any particular tolerance.
To the fullest extent permitted by law, Insight Spatial is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or costs of substitute services, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid for it in the twelve months before the claim, or USD 25.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.
We may update these Terms as the app changes. The effective date above will be updated, and continuing to use the app after a change means you accept the revised Terms.
You may stop using the app and delete it at any time. We may end this licence if you materially breach these Terms; the disclaimers and liability limits survive.
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. Nothing in this section deprives you of the protection of mandatory consumer law where you live.
Apple is not a party to these Terms and has no obligation to provide support for the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.
